Epic Games has sent a letter to U.S. District Judge Yvonne Gonzalez Rogers, arguing that Apple has refused to review Fortnite for the App Store.
The move comes after Apple seemingly left Fortnite in the review process with no indication of when or if it will be approved.
Epic says that this latest impasse is “Apple’s latest attempt to circumvent this Court’s Injunction and this Court’s authority” after years of legal wrangling. Bloomberg‘s Mark Gurman reports that Epic’s petition to the court says that it wants an order enforcing an injunction against Apple.
Apple’s refusal to consider Epic’s Fortnite submission is Apple’s latest attempt to circumvent this Court’s Injunction and this Court’s authority. Epic therefore seeks an order enforcing the Injunction, finding Apple in civil contempt yet again, and requiring Apple to promptly accept any compliant Epic app, including Fortnite, for distribution on the U.S. storefront of the App Store.
Apple had previously told Epic that it would not look into the possibility of reinstating the Epic Games developer account until the litigation between the two companies was concluded. The company had also said that it had asked Epic Sweden to remove the US storefront from its submission so that the game could be made available outside of the United States.
Now, we’re once again in a battle of words between Apple and Epic with no sign of what will come next. All eyes will be on Monday morning to see who blinks first; Apple, Epic, or the court.
